Revisions to EWI Distribution Inc. User Policies
We may change or add to our policies at any time and you agree to be bound by these changes. We will post the amended terms on our site. Updated terms will automatically be implemented after they are initially posted on our site unless we state otherwise. It is your responsibility to access the User Agreement on EWI Distribution Inc. to periodically review the most current terms and conditions. This agreement is effective June 1, 2007. If you don't agree to be bound by the terms of the EWI Distribution Inc. Market User Agreement , do not access our site or use our services.

RELEASE OF RESPONSIBILITY
At EWI Distribution Inc. , the transaction is the responsibility of the buyer and the seller. EWI Distribution Inc. is not involved in any transaction. We, therefore, are NOT responsible for disagreements between buyers and sellers. You agree to release us from any responsibility in disputes between yourself and other Users. We suggest that before buying a vehicle or part from an advertiser on our site, that you conduct a personal inspection of the vehicle or have an appraiser or outside inspector look at the item. Before using the services or buying parts from any of the Businesses Advertised on our site, we recommend that you investigate the company with the Better Business Bureau or other appropriate investigative venues. We are not a guarantor or party to any of the transactions which result from advertising contained on our site, we are only listing the items for sale by private parties or advertising the products for the companies shown and they alone are responsible for any resulting transactions. In other words, be a big boy or girl and fight your own fight.

COPYING AND USE OF CONTENT
1. DO NOT copy EWI Distribution Inc. web pages without our permission.
2. DO NOT reproduce, republish, upload, post or distribute EWI Distribution Inc. materials in any way.
3. DO NOT use EWI Distribution Inc. materials, services or information for commercial purposes without our written consent.
4. DO NOT do anything to overload our system.
5. DO NOT email or post or transmit in any way, material that contains viruses or programs or codes that interfere with the functionality of the EWI Distribution Inc. site. I will hunt you down and thump you on your noggin.
6. DO NOT use the information provided by other Users without their permission. THEY will hunt you down and thump you on your noggin.
7. DO NOT store or collect the information of other Users. Again, THEY will hunt you down and thump you on your noggin and I will help them!

TRADEMARKS
EWI Distribution Inc. is a separate business from Electric Wheels Inc. EWI Distribution Inc. has a contract from Electric Wheels Inc. to use its logo. In addition, EWI Distribution Inc. has certain propriatary images under separate copyright and are protected by copyright laws of the United States. All content and images are proprietary to EWI Distribution Inc. Use of content or images may violate copyright laws, trademark laws, laws of privacy, or other regulations and statutes. Any use of our images, trademarks, content and services is strictly prohibited.

BREACH OF THE LAYO DISTRIBUTION INC. USER AGREEMENT
If you break any part of this agreement, if we can't verify any of your information or if we believe your actions may get us or our Users into legal trouble, we may immediately warn, suspend or terminate your ad with EWI Distribution Inc. We may also take further action.

NO WARRANTY
This web site and our services are provided "as is" and "as available" No warranty. There may be unintentional technical or factual inaccuracies and typographical errors. EWI Distribution Inc. reserves the right to correct inaccuracies at any time, without notice. EWI Distribution Inc. does not warrant the accuracy, timeliness, completeness of any information on the site. EWI Distribution Inc. provides no guarantee against the possibility of miscommunication, failure to store information and communications, or other data. All material obtained from EWI Distribution Inc., through any means, is done at your own discretion and risk. You are solely responsible for any damage to your computer or other electronic system and for the loss of data.

LIABILITY LIMIT
We are not responsible for any damages in connection with this site, even if they came about by our negligence. Our liability is limited to either the amount of any fees you paid to us in the 12 months before the incident or $50, whichever is greater. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Laws vary from state to state.

INDEMNITY
You won't involve us if you get into legal trouble while using EWI Distribution Inc. You agree to indemnify and hold harmless EWI Distribution Inc. and all of its affiliates, agents, employees, and licensors (including third party service providers) from any claim, demand, loss, costs or expense, including attorneys fees, made by any person arising out of your violation of this Agreement, state or federal laws or regulations, or any other person's rights, including, but not limited to infringement of any copyright or violation of any proprietary or privacy right.

NO AGENCY
You and EWI Distribution Inc. are independent contractors. We aren't partners, employers or franchisers. You aren't our partner, employee or franchisee.

ARBITRATION
If you feel the need to take legal action with us, we will only use binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration will take place in Salem, Oregon and judgment may be entered into any court with jurisdiction. While arbitration is pending or ongoing, either you or EWI Distribution Inc. may seek interim or preliminary relief from a court of jurisdiction in Marion County, Oregon in order to protect rights or property.

GENERAL
For legal purposes, all the terms of this User Agreement apply as if you are located right here in Salem, Oregon with us. We can't and don't guarantee that our site will never go down or will never be hacked into by low life scum suckers, or other factors beyond our control. If any part of this User Agreement is found to be invalid or unenforceable, that part will be deleted. The rest of the User Agreement stands.

GOVERNING LAW
The User Agreement and all agreements you enter into with EWI Distribution Inc. are governed by laws in the state of Oregon, USA.

Disputes between you and EWI Distribution Inc. regarding our services may be reported to info@ewidistribution.com. If you feel that your ad with us has not been properly handled you may request a refund and that request will be considered on a case by case basis. For Legal disputes with other Users, please report them to local law enforcement, the postmaster general, or a certified mediation or arbitration entity as appropriate, but leave us alone.
